In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, Ecart Pay wishes to inform the User of the domains or websites www.ecartpay.com (hereinafter the "User") and to people who contract Ecart Pay services (consequently referred to as "Clients"), its Privacy Policy regarding the treatment and protection of personal data of those people who voluntarily communicate, including but not limited to, through email, telephone or any other electronic, oral or written means with Ecart Pay, fill out forms in which personal data is collected or entered and/or the website mentioned here, if this involves the communication of your personal data.

General identification data: full name, gender, date of birth, nationality, state of birth, address, fiscal data (RFC), Unique Population Registry Key (CURP), occupation or profession, advanced electronic signature serial number (if available). In the case of a moral person; name or company name, date of incorporation, nationality, line of business or economic activity, address, tax information (RFC), advanced electronic signature serial number (if available).

Biometric data: facial and/or voice recognition.

Patrimonial data: financial, related to its patrimonial balance, income and bank accounts.
For biometric and/or sensitive data that require special protection, it will be taken into account that for this your express consent will be obtained in writing or by some technological means made available.
IV. PROTECTION OF PERSONAL DATA. –
The User's personal data will be safeguarded based on the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility, which are enshrined in the Law.
V. DATA TRANSFER. –
Ecart Pay may share your personal data with third parties with whom you have previously entered into contracts with confidentiality and personal data protection clauses.
The third parties to which Ecart Pay may transfer personal data are:

Subsidiaries, affiliates, controllers, subsidiaries, associates, commission agents, managers, companies and/or shareholders that are part of the commercial group related to Ecart Pay, professional advisors and/or insurers.

Providers that provide services to Ecart Pay for the maintenance or fulfillment of the legal relationship with Users and/or Clients.

The National Electoral Institute in order to validate your identity to combat identity theft.

Competent authorities, provided for in the applicable legislation.

When Ecart Pay shares your personal data, in such a way that said third parties take the necessary measures to protect the confidentiality and security of the personal data, however, the third party recipients of the personal data will assume before you the same obligations of Ecart Pay indicated in this Policy.
We will understand that you have given your consent for the processing and transfer of your personal data in accordance with this Privacy Policy if you do not express your opposition through the means made known to you in the Privacy Policy.
VI. MEANS AND PROCEDURE TO EXERCISE ARCO RIGHTS AND/OR REVOCATION OF CONSENT FOR THE PROCESSING OF PERSONAL DATA. –
The User may access, rectify and cancel their personal data, as well as oppose their disclosure through the procedures that Ecart Pay has implemented through its Support Area. The User and/or Client may request the format to access, rectify, cancel and oppose their disclosure. Likewise, you will have a period of 5 days to express your refusal to process your personal data for secondary activities. For more information on how to exercise your Rights of Access, Rectification, Cancellation and Opposition (ARCO Rights), oppose the disclosure of your data, revoke your consent or express refusal to treat them, you must contact us by sending an email to support@ecartpay.com
The exercise of any of the ARCO Rights is not a prerequisite nor does it prevent the exercise of another.
The following requirements are essential to fulfill your request:

The name of the owner and address or other means to communicate the response to your request;

The documents that prove the identity or, where appropriate, the legal representation of the owner.

The clear and precise description of the personal data with respect to which one seeks to exercise any of the aforementioned rights and,

Any other element or document that facilitates the location of personal data.

In case the information provided in the form is wrong or insufficient, or the corresponding accreditation documents are not attached. Ecart Pay, within 5 (five) business days following receipt of the request, may require you to provide the elements or documents necessary to process it. You will have 10 (ten) business days to meet the request, counted from the day after you received it. If you do not respond within that period, the corresponding request will be deemed not submitted.
Ecart Pay will notify you of the determination adopted within a maximum period of 20 (twenty) business days from the date on which the request was received, for the purpose that, if appropriate, make it effective within 15 (fifteen) business days after the response is communicated. The response will be given electronically to the email address specified in the form.
VII. OPTIONS AND MEANS TO LIMIT THE USE OR DISCLOSURE OF YOUR PERSONAL DATA. -
You may limit the use or disclosure of your personal data by sending your request to the email support@ecartpay.com
The requirements to prove your identity, as well as the procedure to attend to your request, will be governed by the same criteria indicated in the previous section.
If your request is successful, Ecart Pay will register you in Ecart Pay's own exclusion list so that you stop receiving our promotions. Notifications related to changes in costs or services are not considered in the exclusion lists as it is an obligation of Ecart Pay before the Federal Consumer Protection Office.
VII. USE OF COOKIES. -
Ecart Pay uses various technologies to improve the efficiency of its websites, including your experience when you browse those sites. These technologies include the use of cookies. In such a case, Ecart Pay will publish said modifications on the website www.ecartpay.com where the date of the latest version of the notice will be indicated. We recommend that you periodically visit this page in order to be informed if there is any change to the present.
